CERTIFICATE CANCELLATION
On March 2, 2000, John Jasper, President of the Valley View Water System (Valley View; Company), filed a letter with the Idaho Public Utilities Commission (Commission) requesting that its Certificate of Public Convenience and Necessity No. 338 be cancelled.
Valley View represents that the water system has been sold to Valley View Water & Sewer District, Route 1 Box 350, Kamiah, Idaho 83536. The Company provides supporting documentation (albeit unsigned) showing a sale/purchase date of January 14, 2000.
On April 26, 2000, the Commission, pursuant to Staff inquiry, received a letter from the Valley View Water & Sewer District verifying the purchase (attached).
The Commission’s jurisdiction over water systems is set forth in Title 61 of the Idaho Code. A water district is a political subdivision of the state of Idaho. Reference Idaho Code 52-3201 et seq. The Commission has no statutory jurisdiction over the Valley View Water & Sewer District. Staff recommends that the Certificate of Public Convenience and Necessity No. 338 for Valley View Water be cancelled.
Commission Decision
The Valley View Water System has been sold to the Valley View Water & Sewer District. The Commission no longer has jurisdiction. Does the Commission agree that the related Certificate of Public Convenience and Necessity No. 338 should be cancelled?
