HomeMy WebLinkAbout20240220Decision Memo.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: ADAM TRIPLETT DEPUTY ATTORNEY GENERAL DATE: FEBRUARY 20, 2024 SUBJECT: IN THE MATTER OF THE CITY OF EAGLE AND VEOLIA WATER IDAHO’S JOINT APPLICATION TO AMEND VEOLIA WATER IDAHO’S CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY; CASE NO. VEO-W-23-05. On December 28, 2023, the City of Eagle (“City”) and Veolia Water Idaho, Inc. (“Company”) (collectively the “Applicants”) jointly applied to amend and revise the Company’s Certificate of Public Convenience and Necessity (“CPCN”) No. 143 to remove a portion of service area covering the City from the Company’s certificated service territory. If the Application is approved, the water system assets serving Company’s customers in the eliminated service territory along with other assets serving the Eagle Skate Park in the Eagle Sports Complex will be transferred to the City. The Applicants requested their Application be processed via modified procedure. At the Commission’s January 9, 2024, Decision Meeting, Staff presented a Decision Memorandum recommending the Commission issue a Notice of Application and Notice of Intervention Deadline, setting an intervention deadline of February 14, 2024. No parties petitioned to intervene. STAFF RECOMMENDATION Staff recommends the Commission issue a Notice of Modified Procedure, establishing a public comment deadline of April 10, 2024, and Applicant reply deadline of April 24, 2024.
