HomeMy WebLinkAbout20230518Final_Order_No_35783.pdfORDER NO. 35783 1 Office of the Secretary Service Date May 18, 2023 BEFORE THE IDAHO PUBLIC UTILITIES COMMISSION On September 30, 2022, Veolia Water Idaho, Inc. (“Company” or “Veolia”) applied to the Idaho Public Utilities Commission (“Commission”) requesting authorization to increase its rates and charges for water service. The Company requested an October 31, 2022, effective date. On April 28, 2023, the Commission issued Order No. 35762 approving an annual revenue requirement for the Company of $56,157,933 and a corresponding across-the-board increase for all customer classes including Private Fire Service. The approved revenue requirement was based on adjustments and calculations summarized in Attachment A to Order No. 35762. The Commission directed the Company to submit conforming tariffs and schedules consistent with Attachment B (of Order No. 35762) in Order No. 35762. On May 2, 2023, the Company filed conforming tariffs. After its review, Staff noticed the tariffs inadvertently included language for a Distribution System Improvement Charge that was proposed by the Company but disallowed by the Commission in Order No. 35762. Later, on May 2, 2023, the Company filed corrected conforming tariffs and schedules reflecting the rates approved in Order No. 35762, Attachment B. Staff reviewed the Company’s tariffs and schedules and confirmed the corrected filing conforms to Attachment B in Order No. 35762. On May 8, 2023, the Company filed updated tariffs that incorporated additional language from Order No. 35636 in Case No. VEO-W-22-03, which directed the Company to update Schedule No. 1C—Brian Subdivision Surcharge. The update noted that the surcharge for Brian Water customers will end when the customer’s surcharge balance has been paid in full. At the Commission’s May 9, 2023, Decision Meeting, Staff presented a Decision Memorandum recommending the Commission approve the tariffs as filed on May 2, 2023, and updated on May 8, 2023. The Commission now issues this Order memorializing its approval of the Company’s tariffs. IN THE MATTER OF THE APPLICATION OF VEOLIA WATER IDAHO INC. The Commission has jurisdiction over this matter and the issues in this case under Title 61 of the Idaho Code. Specifically, the Commission regulates “public utilities,” including “water corporations” that serve the public or some portion thereof for compensation. See Idaho Code §§ 61-125, and-129. The Commission has the authority to ensure that rates are just and reasonable under Idaho Code §§ 61-301, -303, -501, -502, and -503. Having reviewed the tariffs filed by the Company in compliance with Order No. 35762, we find the tariffs, including the updates filed on May 8, 2023, comply with our directives in Order Nos. 35636 and 35762. ORDER IT IS HERE BY ORDERED that the Company’s tariffs (corrected conforming tariffs) are approved as filed on May 2, 2023, and subsequently updated on May 8, 2023, effective as of May 1, 2023. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order regarding any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. Idaho Code § 61-626.
