SUZ-W-22-01 VEO-W-22-01 ORDER NO. 35559 On August 9, 2021, the Idaho Public Utilities Commission (“Commission”) issued Order No. 35130, in Case No. SUZ-W-21-02, approving the removal of a 520-acre area in unincorporated Ada County from SUEZ Water Idaho, Inc.’s (“SUEZ” or “Company”) Certificate of Public Convenience and Necessity (“CPCN”) No. 143, and approving a new water management agreement between the Company and City of Eagle. The Company was not ordered to file an amended CPCN No. 143. On December 9, 2021, the Commission issued Order No. 35247, in Case Nos. SUZ-W-18- 02 and EAG-W-18-01, approving the Company’s acquisition of Eagle Water Company. The Company was ordered to file an amended CPCN No. 143 that included the acquired Eagle Water Company service territory. On April 8, 2022, the Company filed Case Nos. SUZ-W-22-01 and VEO-W-22-01, requesting to change its name and operate as Veolia Water Idaho, Inc. As part of those proceedings, Commission Staff (“Staff”) recommended that the Company comply with Order No. 35247 and file an amended CPCN No. 143 that contained an up-to-date service territory. On August 16, 2022, the Company filed a revised CPCN No. 143 in Case Nos. SUZ-W-22-01 and VEO-W-22-01. On October 4, 2022, Staff submitted a Decision Memorandum to the Commission recommending the Commission accept the Company’s revised CPCN No. 143. ORDER NO. 35559 2 COMMISSION DECISION AND FINDINGS The Commission has jurisdiction over this matter and the issues in this case under Title 61 of the Idaho Code. Specifically, the Commission regulates “public utilities,” including “water corporations” that serve the public or some portion thereof for compensation. See Idaho Code §§ 61-125, -129, and -501. We find that the Company has complied with our directives in the above cases with respect to CPCN No. 143. We accept the Company’s revised CPCN No. 143 as filed. ORDER IT IS HEREBY ORDERED that the Company’s revised CPCN No. 143 is accepted as filed. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date upon this Order regarding any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code §§ 61- 626 and 62-619.
