NOTICE OF WITHDRAWAL
OF APPLICATION
NOTICE OF VACATED HEARING
ORDER NO. 28076
On April 5, 1999, a Joint Application in Case No. UWI-W-99-2 was filed with the Idaho Public Utilities Commission (Commission; IPUC) by United Water Idaho Inc. (United Water) and Barber Water Corporation (Barber Water) for an Order approving the sale and transfer of the Barber Water domestic water system to United Water. A Notice of Application and Scheduling in Case No. UWI-W-99-2 was issued by the Commission on April 28, 1999. In its Notice the Commission scheduled a June 23, 1999, evening hearing for the purpose of receiving public comment.
YOU ARE HEREBY NOTIFIED that on June 16, 1999, a Notice of Withdrawal of Application in Case No. UWI W 99-2 was filed with the Commission by the joint applicants, United Water Idaho Inc. and Barber Water Corporation. The Notice is filed pursuant to Rule 67 of the Commission’s Rules of Procedure. The joint applicants request also that the previously scheduled June 23, 1999, public comment hearing be vacated.
COMMISSION FINDINGS
The Commission has reviewed and considered the filings of record in Case No. UWI W 99 2 including our Notice of the June 23, 1999 hearing and the joint applicants’ filed Notice of Withdrawal of Application. Based on our review of same, we find it reasonable to acknowledge the withdrawal of pleadings in Case No. UWI-W-99-2, to vacate the June 23 hearing and to close the case docket.
O R D E R
In consideration of the foregoing and as more particularly described above, IT IS HEREBY ORDERED and the public is HEREBY NOTIFIED that the previously scheduled June 23, 1999, hearing in Case No. UWI W-99-2 is vacated.
IT IS FURTHER ORDERED pursuant to the Notice of Withdrawal of Application filed by the joint applicants, United Water Idaho Inc. and Barber Water Corporation, that all further proceedings in Case No. UWI-W-99-2 be terminated and the case docket closed.
THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61-626.
