UW|-W-15-01 SETTLEMENT STI PULATION SETTLEMENT STIPULATION_1 This Settlement Stipulation ("Stipulation") is entered into by and among United Water ldaho Inc., ("United Water", "Company"), the Staff of the ldaho Public Utilities Commission ("Commission Staff') and the Community Action Partnership Association of ldaho ("CAPAI'), the sole intervenor in this case (collectively, "Parties"). INTRODUCTION The Parties agree the Stipulation represents a fair, just and reasonable compromise of the issues raised in United Water's Application for an increase in water service rates, and the Stipulation is in the public's interest. The Parties believe the Stipulation and its acceptance by the ldaho Public Utilities Commission (Commission) represents a reasonable resolution of the several issues identified in this matter. The Parties, therefore, recommend that the Commission, in accordance with Rule of Procedure (RP) 274, approve the Stipulation and all of its terms and conditions without material change or condition. BACKGROUND 1. On May 21,2015, United Water filed an Application seeking authority to increase the Company's rates for water service in the State of ldaho by an average of 13.2%. lf approved, the Company's revenues would have increased by $5,881,308 annually. The Company requested the new rates become effective June 22,2015. 2. On June 9,2015, the Commission issued Order No. 33316, suspending United Water's proposed effective date for a period of 30 days plus five (5) months or until December 22,2015. On July 7, 2015, the Commission issued Order No. 33334, granting CAPAI'S Petition for lntervention. SETTLEMENT STIPU LAT!ON_2 3. On July 22,2015, the Commission issued Order No. 33344, establishing a procedural schedule, including a technical hearing to commence on November 19, 2015. The Order also convened a Public Workshop for August 19,2015 and that Workshop occurred as scheduled. 4. After the filing of the Application, Commission Staff conducted a thorough investigation of the Company's Application. Commission Staff propounded numerous Production Requests, to which United Water provided responses. 5. On September 15, 2015, representatives of the Parties met to engage in settlement discussions in accordance with RP 272, with a view toward resolving the issues in this case. Although an agreement was not reached at that conference the Parties continued to discuss the matter by telephone and electronic correspondence and have now reached an agreement. 6. Representatives of the Parties also met on September 23,2015 to discuss revisions to United Water's Rules and Regulations. 7. Based on the settlement discussions, as a compromise of the positions in this case, and for other considerations as set forth below, the Parties agree to the following terms. TERMS OF THE STIPULATION 8. Fair Resolution. The settlement is reached as a fair resolution to several disputed issues between the parties, recognizing that no party was likely to prevail on every issue at hearing. The settlement results in a revenue increase that is reasonable, but without resolving specific issues which were in dispute between the Company and Staff. SETTLEM ENT STIPULATION_3 REVENUE REQUIREMENT AND RATE DESIGN 9. Revenue Requirement. Regarding United Water's revenue requirement, the Parties agree that United Water should be allowed to implement revised tariff schedules, in the form attached hereto as Exhibit A, to recover $2,730,000 in additional revenue effective December 22,2015, which is an overall annual increase of approximately 6.00%, and to recover an additional $670,000 effective December 22, 2016, which is an additional annual increase of 1 .39%. The Parties have agreed to this phased-in recovery of the total agreed increase to mitigate the rate impact on customers that would othenarise occur in a single year, and spread the increase during the period the Company is precluded from filing an additional rate case. 10. Rate Spread and Rate Desion. As reflected by Exhibit A, the Parties agree that the additional revenue requirement should be recovered by implementing tariffs, which increase rates and charges on December 22,2015 and December 22, 2016. The rates set forth in Exhibit A reflect a uniform percentage increase to all rate elements. 11. Consumption Normalization Adiustment. United Water and the Staff disagreed on an appropriate normalizing adjustment for water consumption. Without specifically agreeing upon the methodology used to produce them, United Water has agreed for the purpose of this case on the normalized values proposed by Staff. STAY-OUT 12. Rate Case Moratorium. United Water agrees that it will not file a general revenue requirement rate case that results in new rates with an effective date prior to December 22,2017. SETTLEMENT STI PULATION_4 DEFERRALS 13. Deferrals. The Parties agree that the Commission's Final Order in this matter may also approve the following deferrals and amortization periods. a. Deferred Power. 3-year amortization of deferred balance beginning December 2015. b. Rate Case Expense. 3-year amortization of deferred balance beginning December 2015. c. Tank Paintinqs. 20-year amortization of new Gowen Tank painting cost of $208,040 beginning December 2015. d. Pension. 3-year amortization of deferred balance beginning December 2015. The embedded pension expense is proposed to be $1,521,508 in order to establish a new deferral threshold amount. e. The AFUDC equity gross up amount will be amortized over a 3S-year period. f. Relocation Expense. S-year amortization of $70,627 beginning December 2015. g. Conservation Expense. 3-year amortization of $35,000 beginning December 2015. RULES AND REGULATIONS 14. ln its Application dated May 21,2015, United Water proposed several miscellaneous changes to its Rules and Regulations Governing the Rendering of Water Service, which are on file with the Commission. The proposed revisions were set forth in Exhibit No. 24 accompanying the testimony of Marshall Thompson. 15. During the course of the proceeding, Staff propounded to United Water several Production Requests regarding the proposed changes and United Water answered the requests in writing. SETTLEM ENT STI PULAT!ON_s 16. On September 23,2015, representatives of the Company met with members of Staff and counsel for CAPAI to discuss the proposed revisions. 17. Based thereon, the Parties have agreed to modifications of the changes to the Rules and Regulations as initially proposed by United Water. Those modifications are shown on the attached Amendment 1 to Exhibit 24. LOW INCOME 18, Backqround. lnitiated in 2005, United Water Cares is a program by which United Water provides financial assistance, in the form of bill reductions, to low-income customers experiencing difficulty paying their bills for water service from United Water. Eligible participants are certified to United Water by El-Ada Community Action Partnership, a non-profit corporation and a member of the Community Action Partnership Association of Idaho (CAPAI). 19. Operation. The program is funded by United Water plus a one-time contribution from unclaimed developer deposits of $95,656. None of the program costs are included in customer rates. Since inception, total contributions to the program are approximately $146,000. Although there is no cap or upper limit on United Water's annual contribution to the program the amount of per customer assistance is currently capped at $65, which was established in 2011. 20. Agreed Proqram Enhancements. After reviewing program operation and customer need, CAPAI and United Water agree that the cap on per customer contribution should be increased to $75, effective January 1,2016, an increase of approximately 15%. Thereafter, the per-customer cap amount would be increased by the same percentage (rounded up to the nearest dollar) as the percentage increase in SETTLEMENT STIPULATION-6 revenue awarded by the Commission to United Water in subsequent general rate proceedings. The percentage increase mechanism does not apply to the agreed upon increase on December 22,2016. 21. Rationale. CAPA! and United Water believe the increase to occur January 1,2016 is appropriate since the cap has not been adjusted in five years. Further, the mechanism for subsequent increases provides stability and predictability to the program. 22. Support of Rate Case Settlement. CAPAI supports the terms the agreement between Staff and United Water with respect to increased revenue requirement and its recovery. FURTHER COOPERATION 23. The Parties will file written testimony supporting this Stipulation on or before November 6, 2015. 24. Meet and Confer. As noted above, the Commission Staff and United Water have agreed, for the purpose of this case, on values to be used for normalizing water consumption, but have not agreed on the methodology to produce them. Staff and United Water representatives will confer with a view toward resolving those disagreements for the purpose of future cases. 25. Just and Reasonable: Best Efforts. The Parties agree that this Stipulation is in the public's interest and that all of its terms and conditions are fair, just and reasonable. The Parties agree to use their best efforts to obtain Commission approval of the Stipulation in order to have new rates implemented by December 22,2015. SETTLEM ENT STIPULATION-7 26. No Acknowledqement. No Party shall be bound, benefited or prejudiced by any position asserted in the negotiation of this Stipulation, except to the extent expressly stated herein, nor shall this Stipulation be construed as a waiver of the rights of any Party unless such rights are expressly waived herein. Execution of this Stipulation shall not be deemed to constitute an acknowledgement by any Party of the validity or invalidity of any particular method, theory or principle of regulation or cost recovery. No Party shall be deemed to have agreed that any method, theory or principle of regulation or cost recovery employed in arriving at this Stipulation is appropriate for resolving any issues in any other proceeding in the future. No findings of fact or conclusion of law other than those stated herein shall be deemed to be implicit in this Stipulation. 27. Commission Approval. The obligations of the Parties under this Stipulation are subject to the Commission's approval of this Stipulation in accordance with RP 274-276. 28. Confidentiality. The Parties agree that this Stipulation represents a compromise of the positions of the Parties. Therefore, other than any testimony filed in support of the approval of this Stipulation, and except to the extent necessary for a Party to explain before the Commission its own statements and positions with respect to the Stipulation, as directed by RP 272, all statements made and positions taken in negotiations relating to this Stipulation shall be confidential and will not be admissible in evidence in this or any other proceeding. SETTLEMENT STIPU LATION_8 29. Best Efforts. The Parties submit this Stipulation to the Commission and recommend approval in its entirety. Parties shall support this Stipulation before the Commission, and no Party shall appeal a Commission Order approving the Stipulation or an issue resolved by the Stipulation. lf this Stipulation is challenged by any person not a party to the Stipulation, the Parties to this Stipulation reserve the right to file testimony, cross-examine witnesses, and put on such case, as they deem appropriate to respond fully to the issues presented, including the right to raise issues that are incorporated in the settlements embodied in this Stipulation. Notwithstanding this reservation of rights, the Parties to this Stipulation agree that they will continue to support the Commission's adoption of the terms of this Stipulation. 30. Risht to Withdraw. If the Commission rejects any part or all of this Stipulation, or imposes any additiona! material conditions on approval of this Stipulation, each Party reserves the right, upon written notice to the Commission and the other Parties to this proceeding, within fourteen (14) days of the date of such action by the Commission, to withdraw from this Stipulation. ln such case, no Party shall be bound or prejudiced by the terms of this Stipulation, and each Party shall be entitled to seek reconsideration of the Commission's Order, file testimony as it chooses, cross-examine witnesses, and do all other things necessary to put on such case as it deems appropriate. 31. Counterparts. This Stipulation may be executed in counterparts and each signed counterpart shall constitute an original document. SCHEDULE NO. 6 MUNICIPAL FRANCHISE FEES Purpose: The purpose of this schedule is to set forth the charges such as license, franchise, business occupation, operating, excise, use of street taxes or other charges that are imposed on the Company by municipal corporations and billed separately by the Company to its customers within the corporate limits of a municipality, Applicability: This schedule is applicable to the gross operating revenues received by the Company from the sale of water and water services within the corporate limits of the city. Rate: The rates and charges for the sale of water and water services provided under the Company's schedules will be proportionately increased by the following charge within the municipality on and after the effective date of the applicable municipal ordinance. Since this fee is not recovered in tariffed rates, the cost will be passed to customers. The charge will be shown as a separate item on the customer's billing. No. 3 Availability: To all customers who have sprinkler systems and/or inside hose connections supplied by a dedicated service line for fire fighting purposes. Sheet 22. Section 44 44. All private fire service connections from the main to the property line, including allvalves, shall be furnished and installed by the Company. Allfire service line connections will be separate from potable service lines, except that residential fire protection systems conforming to NFPA 13D standards for flow through usage will be permitted on the meter size range one-inch or smaller (<=1in). Sheet 22. Section 45 45. The Company reserves the right to require at any time, a meter and appropriate backflow prevention device to be furnished and installed on the customer's fire service connection. The customer shall be responsible to pay the associated costs of materials, installation and overheads. The meter and required backflow prevention device shall be inspected and approved by the Company. Sheet 9. Sch. No. 5 2. Reconnection Charge. Application: This charge is applicable to all customers where water has been physically turned off for nonpayment of a delinquent bill or the Company has determined that a dangerous condition exists due to failure to provide or maintain appropriate cross connection control. CROSS GONNECTION _ BACKFLOW PREVENTION DEVICES Sheet 13-{4. Section 14 14. ln accordance with its Cross Connection Control Program, as required by the ldaho Department of Environmental Quality, the Company shall maintain an inspection program to locate cross connections and determine suitable protection. An appropriate backflow prevention assembly shall be installed on any customer's service connection where an actual or potential health hazard is determined by the Company to exist. lnstalled assemblies shall appear on the ldaho Department of Environmental Quality's list of approved backflow prevention assemblies and be inspected by the Company. Sheet 15. Section 15 15. ln the event a backflow prevention device is required, it shall be installed and maintained at the customer's expense. A dangerous condition posing a threat to public health may result from a customer's failure to properly install or maintain the required device. The required device shall be tested annually by a licensed tester at the customer's expense. lf the Company determines that the device has not been tested annually, it may issue a notice to terminate service absent proof of testing. lf the customer fails to provide proof that the device has been tested or otherwise fails to comply with the Company's notice, the Company may discontinue service. lf the Company determines that a dangerous condition exists and immediate action is necessary to eliminate an immediate health hazard, it may discontinue service without notice to the customer in accordance with the IPUC's Utility Customer Relations Rules (IDAPA 31.21.01.303). Sheet 15. Section 16 16. In accordance with ldaho State Plumbing Code Section 602.0, regarding Unlawful Connections (see IDAPA 07.02.06.01 1), no potable water supply piping on a premise served by the Company shall be made in such a manner that it will be possible for non-potable water to enter any part of the Company's water system. The Company shall determine the type of device or permanent physical separation required for protection in accordance with its Cross Connection Control Program. lnstallation of any device or separation shall be inspected by the Company.
