TO AMEND AND REVISE CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY NO. 143 TO INCLUDE BRITTANIA HEIGHTS CASE NO. UWI-O7- NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE NOTICE OF COMMENT /PROTEST DEADLINE YOU ARE HEREBY NOTIFIED that on April 23, 2007, United Water Idaho Inc. (United Water; Company) filed an Application with the Idaho Public Utilities Commission (Commission) requesting authority to amend and revise its Certificate of Public Convenience and Necessity No. 143 , as amended, to include an area located on McDermott Road in Canyon County, Idaho identified as Brittania Heights. The Brittania Heights subdivision is located in the vicinity of United Water s Belmont Heights service area. The Application of the Company includes a legal description and map of the Brittania Heights subdivision. The developer of Brittania Heights, Patriot Capital Partners LLC, has requested that United Water extend domestic water service facilities to the area and United Water has determined it has the capability to provide service. Water service facilities will be extended to the area pursuant to United Water s Rules and Regulations governing extensions. As represented in the Company s Application, the proposed development of Brittania Heights is not within the authorized service territory of any other water utility under the jurisdiction of the Commission nor, it states, will it interfere with the operations of any such utility. United Water further contends that the City ofNampa, Idaho, a municipal water provider with facilities in the vicinity of Brittania Heights, has consented to service by United Water. United Water submits that the extension into this area is consistent with the public convenience and necessity. YOU ARE FURTHER NOTIFIED that the Commission has reviewed the filings of record in Case No. UWI-07-03 and has preliminarily found that the public interest in this matter may not require a hearing to consider the issues presented, and that issues raised by the NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE NOTICE OF COMMENT/PROTEST DEADLINE Company s filing may be processed under Modified Procedure, i., by written submission rather than by hearing. Reference Commission Rules of Procedure, IDAP A 31.01.01.201-204. YOU ARE FURTHER NOTIFIED that the deadline for filing written comments or protests with respect to United Water s Application and the use of Modified Procedure in Case No.UWI-07-03 is Friday, June 8, 2007. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the deadline, the Commission may consider the matter on its merits and may enter its Order without a formal hearing. If comments or protests are filed within the deadline the Commission will consider them and in its discretion may set the matter for hearing or may decide the matter and issue its Order based on the written positions before it.
