FOR APPROVAL OF ITS WATER CONSERVATION PLAN AND APPROVAL OF A SURCHARGE NOTICE OF APPLICATION CASE NO. UWI-06- NOTICE OF MODIFIED PROCEDURE ORDER NO. 30228 YOU ARE HEREBY NOTIFIED that on December 1 , 2006, United Water Idaho Inc. filed an Application requesting approval of an updated water conservation plan, along with implementation of a surcharge to pay for implementation of the plan. In the Company s last rate case, UWI- W-04-, the Commission directed the Company to update its conservation plan and file it with the Commission on or 'before April 1 , 2006. Prior to that deadline, United Water asked for an extension, and the Commission subsequently approved a new filing date of December 1 , 2006. The Company filed its Application requesting authority to implement its plan and charge customers a surcharge to pay for its implementation. YOU ARE FURTHER NOTIFIED that United Water s Application states that it evaluated 91 potential conservation measures, selecting 17 for further study and evaluation. This analysis produced a list of seven conservation measures the Company believes are cost effective. United Water currently spends approximately $124 200 per year on conservation measures. the seven additional programs become part of its conservation plan, those costs would increase to approximately $244 000 per year. The Company proposes to implement the changes over the next three years. YOU ARE FURTHER NOTIFIED that United Water requests approval of a surcharge of 0.33% on amounts billed under the Company s tariff Schedule 1 , General Metered Service, to recover the costs of its conservation programs. The Company estimates the surcharge would add approximately $1.20 annually to the average residential customer s bill. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 30228 YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission s Rules of Procedure, IDAPA 31.01.01.201-204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within thirty (30) days from the service date of this Order. The comment must contain a statement of reasons supporting the comment. Persons desiring a hearing must specifically request a hearing in their written comments. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that the Application of United Water Idaho Inc. for approval of its water conservation plan and approval of a surcharge be processed by Modified Procedure, IDAPA 31.01.01.201-.204. Persons interested in submitting written comments in this matter must do so no later than 30 days from the service date of this Order.
