TO AMEND AND REVISE CERTIFICATE OF CONVENIENCE AND NECESSITY NO. 143 NOTICE OF PREHEARING CONFERENCE CASE NO. UWI-06- On April 26, 2006, United Water Idaho Inc. (United Water; Company) filed an Application with the Idaho Public Utilities Commission (Commission) for authority to amend and revise its Certificate of Public Convenience and Necessity No. 143 , as amended. Reference Idaho Code ~ 61-526; IDAPA 31.01.01.112. United Water seeks to add an area known as the Trailhead Community to its certificated service territory. The area of expansion is located in Ada County north of the City of Eagle in an area more particularly described as: a parcel of land being all of the West 1/2 of the Southwest 1/4 of Section 27 and all of Section 28, Township 5 North, Range 1 East, Boise Meridian, Ada County, Idaho. On May 10, 2006, the City of Eagle filed letter comments with the Commission apprising the Commission of the City s intent to serve the Trailhead Community, objecting to United Water s Certificate Application and in a May 31 , 2006 letter filing requested a hearing. What ensued was an informal stay of proceedings. On February 21 , 2007, Kastera homes, the developer of Trailhead Community, filed letters with the Commission indicating that negotiations between the City of Eagle and Kastera for annexation were unsuccessful. Kastera concludes that the City of Eagle is not able to provide water service to its project. On March 6, 2007, United Water filed a Motion requesting that the Commission convene a prehearing conference to discuss the scheduling of further proceedings. YOU ARE HEREBY NOTIFIED that a prehearing conference in Case No. UWI- 06-04 is scheduled at 2:00 P.M. ON THURSDAY. MARCH 22. 2007 AT THE COMMISSION'S HEARING ROOM. 472 WEST WASHINGTON STREET. BOISE. IDAHO to establish a prefile schedule and hearing date. NOTICE OF PREHEARING CONFERENCE YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission s jurisdiction under Title 61 of the Idaho Code and that the Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAPA 31.01.01.000 et seq. YOU ARE FURTHER NOTIFIED that discovery is available in Case No. UWI- 06-04 pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.221-234. YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act (ADA). Persons needing the help of a sign language interpreter or other assistance in order to participate in or to understand testimony and argument at a public hearing may ask the Commission to provide a sign language interpreter or other assistance at the hearing.
