On April 12, 2006, the Commission granted the Petition to Intervene filed by Boise
Residents Against Commercial Exploitation, Inc. (BRACE). Order No. 30010. On April 26
2006, United Water filed three motions directed to BRACE and its participation in the case: (1)
Motion for Procedural Order; (2) Motion for Order Compelling Discovery; and (3) Motion for
Order Shortening Time.
On April 30, 2006, BRACE filed a Withdrawal of its Petition to Intervene. On May
, 2006, United Water filed a withdrawal of its three procedural motions, contingent upon the
Commission granting the withdrawal of BRACE's Petition to Intervene.
DISCUSSION
We find, based upon the files and records herein, as well as the lack of objection by
any party, that the request of BRACE to withdraw its Petition to Intervene should be granted.
Further, because this Order grants BRACE's request and dismisses it from this proceeding, we
find that the three motions filed by United Water are now moot.
ORDER
IT IS HEREBY ORDERED that the request of BRACE to withdraw its Petition to
Intervene is granted. BRACE is dismissed from this proceeding.
IT IS FURTHER ORDERED that the request of United Water to withdraw its
motions as referenced above is hereby granted.
THIS IS A FINAL ORDER. Any person interested in this Order may petition for
reconsideration within twenty-one (21) days of the service date of this Order with regard to any
matter decided in this Order. Within seven (7) days after any person has petitioned for
reconsideration, any other person may cross-petition for reconsideration. See Idaho Code ~ 61-
626.
