RE: Request To Consolidate Water Service for Property on Floating Feather Road, Eagle, Idaho

We are requesting the Idaho Public Utilities Commission allow a single company provide potable
water service to the property located at 1501 & 1601 W. Floating Feather Road in Eagle Idaho.
This site is 48.54 acres and has recently been approved by the Eagle City Council for development
of 41 single family lots. We are constructing a pressurized irrigation system for this subdivision, so
we only need potable water from a water company.
A portion of this subdivision is in the certificated area for Eagle Water Company, and a portion is in
the certificated area for United Water Idaho. Since this site is relatively small and will comprise
only 41 lots, it is desirable to only have one water company service the site.
Initially, we believed we were only in Eagle Water Company s area and were trying to work with
them to provide adequate service. They informed us that there was a water line that could service
us at the Northeast comer of our site, but until they had several easements from property owners to
the South for an additional water line extension, they could not guarantee adequate service for our
site. After various phone conversations and meetings with their representatives, we felt it necessary
to make our request for service in writing. A copy of this letter is attached.
Since this letter, we have contacted Eagle Water Company s representatives and have been told that
there has been no effort put forth to acquire the necessary easements, and they did not know when
they would have an answer for us.
At this point we contacted the Idaho Public Utilities Commission to research our options. We met
with Randy Lobb and Rick Sterling to discuss our situation and our concerns since we would like to
have lots available for homes next spring. They informed us that since our property was in both
water companies' certificated areas , we could request United Water Idaho for service if they were
able to provide the flows we needed. They also advised us to contact the State of Idaho Division of
Environmental Quality to determine if Eagle Water Company had any moratorium for new service.
Our representative, Richard Tomlinson, contacted both United Water and DEQ. United water
informed Mr. Tomlinson that they had a well to the Northeast of our site and that there was an
existing water main along our entire North boundary. United Water was confident they would be
able to provide our service requirements.
Mr. Monty Marchus at DEQ informed Mr. Tomlinson that there was indeed a sort of moratorium on
any additional connections to Eagle Water Company s System until they can meet minimum state
requirements. Mr. Marchus forwarded a letter written to Eagle Water Company referencing this.

After receiving this letter from DEQ and speaking with Mr. Sterling at the PUC, Mr. Tomlinson
again contacted Mr. John Lee at United Water Idaho to confirm their ability to serve our site. Mr.
Lee and Mr. Tomlinson met to discuss the water system design and costs. They prepared a water
design with material quantities that we could send to our contractor for construction costs. After
Mr. Lee received these costs from our contractor, he prepared a letter stating they could deliver the
necessary fire flows and was able to give us a total cost of construction as well as their timing for
service. A copy of this letter is attached.
Since United Water Idaho is able to provide the required service to our site and meet our schedule
it is our preference that they serve our subdivision with potable water. We have tried to work with
Eagle Water Company, but in over two months have not received the requested information United
Water was able to give us in a few days. Additionally, it does not seem that Eagle Water Company
has any plans in the near future to try to provide service to our site.
We hope you understand our situation and allow United Water Idaho to provide service to our site.
We believe that our builders, future residents and the City of Eagle Fire Department will be better
served by this Company.

RE: Covenant Hill Subdivision
Dear Robert
I am writing to follow up on our meeting of August 10 2005, when we discussed the timing and fire flow
requirements for the Covenant Hill Subdivision.
As we discussed, due to the size of some of the homes to be built in this subdivision, the fire flow demand
will be more than average. The Eagle Fire Department requires a minimum of 2000 gallons per minute
measured at 20 psi for a duration of 2 hours for homes up to 6 200 square feet. This is in accordance with
table B105.1 of the 2003 International Fire Code. At our meeting you thought your water system would
be able to accommodate this.
However, you also mentioned that you would need to connect to an existing well south of our site. This
connection would require some easements from adjacent property owners and additional mainlineextensions.
Since our timing for home construction to start is next Spring, we need to know that the water system will
be in place and fully functioning to the above mentioned requirements.
Hillview Development Corp. has authorized me to start the construction drawings based on our meeting
with you last week. Since the on site water design will be done by us, should I be working on any offsite
mainline extensions or ,vill your company by workingon.these concurrently.
If a connection to the well south of this property is held up, can your company meet the fire flow demands
with the single connection to the northeast of our site?
Will you please write a letter back to me or to Hillview Development letting us know your timing on the
water system upgrades or extensions and some verification that you can meet the required fire flows for
this subdivision.

RE:Project Specific Calculations
Dear Mr. DeShazo:
'Ibis letter will confirm and augment discussions on the above referenced subject at your recent
meetings with Department of Environmental Quality (DEQ) staff. These are the key points:
1. There are quantity and pressure concerns with this public water system, and staff advised
you that each project (proposing to serve additional customers and requiring DEQ plan
and specification approval) must include project specific calculations to demonstrate the
ability to serve that project.
2. We are sure that you and your engineer knew that those calculations would include
hydraulic modeling or calculations to demonstrate adequate pressure. It may not have
been obvious that those calculations must also demonstrate adequate production capacity.
As stated at the meeting, Eagle Water Company cannot meet peak demand if it loses one
of its sources. This does not meet the following state requirement: "With any source out
of service,. the rema1n1ng source or. soureesshaU. b~ capable of providing either the peak
hour demand of the system or maximum daily pumping demand plus equalization
storage" (IDAPA 58.01.08.SS0.03.
p).
3. Therefore, unless additional information is provided, DEQ will not be able to approve
additional connections to this water system until an additional source or sources are
provided that are large enough to meet minimum state requirements.

Dear Mr. Sterling:
At the request of the Hillview Deve1opment Corpord.tion, the developer/owner of the proposed
Covenant Hill Subdivision, I am sending you cost and timing information necessary for United
Water Idaho to S(..TVe this project.
met with Mr. Rich Tomlinson, the owner s engineer, and comp1eted the sizing and preliminary
dcsign necessary for United Water Idaho to serve the proposed project. The design includes
providing a tIre protection now of 2,000 GPM to the subdivision.
Based on the design the developer s construction manager provided to United Water Idaho, the
total construction cost for the installation of the pipe, fittings, fire hydrants, and services
necessary to Rerve the new subdivision is estimated to be $164,807. This figUTC is comprised of
the contractor s cost ofSt46,870 for materials and installation, plus United Water Tdaho
inspection and overheads,
Mr. Tomlinson indicates it wilt take approximately three weeks for him to complete the water
drawing based on our initial review. Once United Water Idaho has approved Mr. Tomlm5on
water dr~wing, construction of the water facilities could start within a couple of weeks. United
Walcrjs not required t'o get pre~approval&om the Department of Environn1ental Quality before
construction of main line extensions.
