STIPULATION TO FURTHER
EXTEND PERIOD OF
SUSPENSION
On May 20, 2008, Teton Springs Water & Sewer Company, LLC (Teton Springs;
Company) filed an ApplicatiQn with the Idaho Public Utilties Commission (Commission)
requesting a Certificate of Convenience and Necessity to provide domestic, culinary water
service in Teton County, Idaho to customers within the Teton Springs Golf and Casting Club
planned unit development. The Company also requested that the Commission approve a change
in existing rates and charges for water service and approve the Company's proposed Rules and
Regulations Governing the Rendering of Water Service.
On June 12, 2008, the Commission in Order No. 30571 issued Certificate of
Convenience and Necessity No. 471 to Teton Springs, authorized continued water service under
the existing flat rate, and suspended the remainder of the Company's Application.
STIPULATION TO FURTHER
EXTEND PERIOD OF SUSPENSION 1
On August 6, 2008, the Commission issued a Notice of Modified Procedur and
Scheduling in Case No. TIS- W -08-01. The deadline for filing comments was September 5,
2008. Comments were fied by a customer of the Company and Commission Staff. Pursuat to
Amended Notice of Scheduling and thereafer infonnal agreement, the reply comment deadline
for Teton Springs was extended from September 19, 2008 to October 10, 2008. In its reply
comments, Teton Springs requested the opportunity for ora argument.
On November 7, 2008, oral arguent in Case No. TTS-W-08-01 was held. On
November 21, at the request of the Commission, additional testimony was fied on behalf of the
Company. Commission Staff and Teton Springs agree that the record in Case No. TIS-W-08-01
should be considered closed and tht the issues rased in this cas ar ready for Commission
deliberation and decision.
The Commission in Order No. 30571 suspended the Company's proposed schedule of
rates and charges for water service for a period of thirty (30) days plus five (5) months from June
20, 2008, or until such earlier time as the Commission might issue an Order, accepting, rejecting,
or modifyng the Application in ths case. Idaho Code § 61-622. On December 5, 2008, the
paries stipulated to extend the period of suspension to Janua 16, 2009.
Cognizant of the Commission's calenda and other demands on its time and to
provide the Commission with suffcient time to deliberate and decide this matter, the stipulating
paries agree to furter extend the period of suspension in Case No. TIS-W-08-01 from Januar
16,2009 to Friday, Janua 23,2009. The paries agree that this additional extension is effective
without furher notice or order.
