TTS-w-os-oi COMPAN, LLC FOR THE ISSUANCE OF A ) CERTIFCATE OF CONVENINCE AN ) NECESSITY, FOR APPROVAL OF RATES ) AN CHAGES FOR WATER SERVICE, ) STIPULATION TO EXTEND AN FOR APPROVAL OF RULES AN ) PERIOD OF SUSPENSION REGULATIONS GOVERNING THE ) RENDERIG OF WATER SERVICE ) ) On May 20, 2008, Teton Sprigs Water & Sewer Company, LLC (Teton Sprigs; Company) filed an Application with the Idaho Public Utilities Commission (Commssion) requesting a Certficate of Convenience and Necessity to provide domestic, culinary water servce in Teton County, Idaho to customers withn the Teton Sprigs Golf and Casng Club planed unit development. The Company also requested that the Commssion approve a change in existing rates and charges for water service and approve the Company's proposed Rules and Regulations Governg the Rendering of Water Service. On June 12, 2008, the Commssion in Order No. 30571 issued Certficate of Convenience and Necessity No. 471 to Teton Springs, authorized continued water serce under the existing flat rate, and suspended the remainder of the Company's Application. STIULATION TO EXTEND PERIOD OF SUSPENSION 1 On August 6, 2008, the Commssion issued a Notice of Modified Procedure and Schedulîng in Case No. TTS-W-08-01. The deadline for filing comments was September 5, 2008. Comments were fied by a customer of the Company and Commission Staff. Pursuant to Amended Notice of Scheduling and thereafter informal agreement, the reply comment deadline for Teton Springs was extended from September 19, 2008 to October 10, 2008. In its reply comments, Teton Springs requested the opportunity for ora argument. On November 7, 2008, oral arguent in Case No.. TTS-W-08-01 was held. On November 21, at the request.ofthe Commission, additional testimony was fied on behalf of the Company. Commission Staff and Teton Sprigs agree that the record in Case No. TTS-W-08-01 should be considered closed and that the issues raised in this case are ready for Commission deliberation and decision. The Commission in Order No. 30571 suspended the Company's proposed schedule of rates and charges for water service for a period of thirt (30) days plus five (5) months from June 20, 2008, or until such earlier time as the Commission might issue an Order, accepting, rejecting, or modifying the Application in this case. Idaho Code § 61-622. Cognizant of the Commission's calendar and other demands on its time and to provide theCornssion with suffcient time to deliberate and decide this mattr, the stipulating paries agree to extend the period of suspension in Case No. TTS-W-08-01 from December 20, 2008 to Friday, Januar 16, 2009.
