Dear Idaho Public Utilities Commission,
I own a home located at 17 Mountain Meadows Lane, Victor, Idaho, in Teton Springs.
In reviewing the proposed transfer I would share the following observations and comments.
· There is a lawsuit being brought against the Teton Springs Golf and Casting (and others)
which the commission should be aware of in US District Court case number 4:2008cv00099.
· There is also a class action lawsuit that has been brought against a mortgage broker and a
lender (case number 1:2008cv00352) at Teton Springs which represents a substantial number of
homes Teton Springs.
· A formal complaint has been filed and is under review with HUD against Teton Springs for
violation of the Interstate Land Sales Act.
· The development appears to be in significant "distress". Virtually every home is "under
water" with large numbers in foreclosure. The PUC should thoroughly understand market
conditions and how these conditions could effect Teton Springs Water and Sewer bottom line.
· The PUC should review that Teton Springs Water and Sewer is proactively watching the
escalating foreclosure market closely and it's policy for:
1. discontinuing service quickly on the many "known" never occupied properties with
delinquent bills .
2. discontinuing service on delinquent accounts in short sales status 3. what impact the
litigation and hud findings may have on Teton Springs Water and Sewer.
As a homeowner, a litigant in both the above cases, and a member of the HUD complaint it is
my opinion that the PUC consider carefully the above factors prior to rendering its final
decision in this matter.
