Batt & Fisher LLP and files these brief comments in response to the Commission s Notice of
Stipulation and Notice of Comment Deadline, Order No. 29333.
Terra Grande reaffirms its commitment to transfer its water system, excluding certain real
property and appurtenances and personal property, to United Water Idaho, Inc. ("United Water
However, due to discrepancies in the chain of title to ownership of the water system property
Terra Grande has been delayed in executing the Stipulation to transfer the system be entered into
by United Water, the Idaho Public Utilities Commission Staff and itself. Terra Grande is
currently resolving these discrepancies which will clarify and vest title to the water system
property in itself so that certain of it can be transferred to United Water. Terra Grande estimates
that this process will be completed on before January 20, 2006. Once this has occurred, Terra
Grande will execute the Stipulation, moving this transaction closer to completion.
