Re: Request for Authority to Borrow Funds (Security Issuance)
The letter dated October 27, 2004, from James A Sewell & Associates, Consulting
Engineers, has been assigned Case No. SWS-04-01 and treated as an Application for
Authority to Borrow Money (Security Issuance). The letter refers to previous Orders of this
Commission authorizing loan amounts for the utility. The letter also request "input of the IPUC
before proceeding with taking on the additional debt to complete the proposed construction. . .
As previously discussed with Commission Staff, in order to process your request for
authority to borrow money it will be necessary to obtain the proper documentation as well as the
proper amount of the requested loan, and in essence to submit a complete Application to the
Commission.
In order to accomplish this, Commission Staff will need additional time to investigate
obtain the proper documentation and compile the proper loan amount, as the amount stated in the
October 27 letter has changed. Also, as discussed with Commission Staff, this process will take
longer than the thirty (30) day time period for processing a Security Issuance stated in Idaho
Code ~ 61-904. Therefore, by your signature(s) below, you hereby acknowledge and waive the
thirty (30) day time period prescribed by 1. C. ~ 61-904, and consent to have this matter decided
by the Commission at its December 20, 2004 decision meeting, or at such earlier time as the
Commission Staff may obtain the proper documentation, complete the loan amount requested by
the Application, and bring this matter before the Commission. Thank You.
