SUZ-W-20-02 ORDER NO. 34859 On November 18, 2020, Micron Technology, Inc. (“Micron”) filed a late petition to intervene in the proceeding. No one opposed Micron’s petition. Having reviewed the record, we conditionally grant Micron’s petition as follows. FINDINGS Commission Order No. 34819 set a November 12, 2020 deadline for petitions to intervene. Micron filed its petition to intervene on November 18, 2020. Micron’s petition is, therefore, untimely. Untimely petitions to intervene are governed by Rules 71-75, IDAPA 31.01.01.071- .075. Based on the record, we find that Micron has shown good cause for the untimely filing, and that it has a direct and substantial interest in this proceeding and will not unduly broaden the issues. We thus find it reasonable to grant Micron’s untimely petition to intervene on the condition that Micron not delay, disrupt, or unduly broaden the issues in this proceeding. We note that, per Rule 73, Micron is bound by all prior orders and notices issued in the case. O R D E R IT IS THEREFORE ORDERED that Micron’s petition to intervene is granted on the conditions specified above. IT IS FURTHER ORDERED that all parties in this proceeding serve all papers hereafter filed in this matter on all parties of record.
