SUBJECT:SUEZ'S UNOPPOSED MOTION FOR STAY, IN THE MATTER OF THE
JOINT APPLICATION OF SUEZ WATER IDAHO, INC., TO ACQUIRE
EAGLE WATER COMPANY; CASE NOS. SUZ-W-18-02, EAG-W-18-01
On November 15, 2018, Suez Water Idaho Inc. and Eagle Water Company, Inc. jointly
applied to the Commission for an order approving Suez's proposed acquisition of Eagle Water.
During the proceeding, lntervenor City of Eagle sued in District Court and claimed a right of first
refusal to buy Eagle Water's water system. Because the Commission's decision on the Suez/Eagle
Water Application may be affected by the outcome of the District Court litigation, Suez has moved
to stay the Commission proceeding pending a final resolution of that litigation. The other parties
to the Commission proceeding do not oppose the motion.
