On June 8, 2021, Eagle Water Company, Inc. (“Eagle Water”) and SUEZ Water Idaho
Inc. (“SUEZ”) (collectively the “Companies”) filed a motion to recommence proceedings in this
docket. The same day, Eagle Water and SUEZ filed an amendment to its joint application
requesting approval of the acquisition of Eagle Water assets by SUEZ (“Amended Joint
Application”) and amendment of Certificate of Public Convenience and Necessity No. 143.
On July 14, 2021, the Commission granted SUEZ and Eagle Water’s motion to
recommence proceedings and issued a Notice of the Amended Application. Order No. 35104.
At the Commission’s August 31, 2021 Decision Meeting, Staff represented that the
parties had met and discussed procedure and scheduling for this case. Staff noted that not all parties
agreed on procedure—with some parties preferring a technical hearing to modified procedure—
but the parties agreed on a general timeline by which to process this matter.
The Commission now sets deadlines and provides notice of a telephonic public
workshop and a telephonic customer hearing.

NOTICE OF MODIFIED PROCEDURE
YOU ARE FURTHER NOTIFIED that the Commission has preliminarily determined
that the public interest may not require a formal hearing in this matter, and that it will proceed
under Modified Procedure pursuant to Rules 201 through 204 of the Commission’s Rules of
Procedure, IDAPA 31.01.01.201 through .204. The Commission notes that Modified Procedure
and written comments have proven to be an effective means for obtaining public input and
participation.
YOU ARE FURTHER NOTIFIED that Staff and Intervenors must file any
comments by October 13, 2021.
YOU ARE FURTHER NOTIFIED that Staff and Intervenors must file any
responses by October 20, 2021.
YOU ARE FURTHER NOTIFIED that the Companies must file reply comments by
October 27, 2021.
YOU ARE FURTHER NOTIFIED that persons desiring to state a position on this
Application may file a written comment explaining why the person supports or opposes the
Application. Persons interested in filing written comments must do so by November 8, 2021.
Comments must be filed through the Commission’s website or by e-mail unless computer access is
unavailable. To comment electronically, please access the Commission’s home page
at www.puc.idaho.gov. Click the “Case Comment Form” and complete the form using the case

Commission Secretary, the customer must also e-mail the Companies at the e-mail addresses listed
below if provided by the Companies. If computer access is unavailable, then comments may be
mailed to the Commission and Companies at these addresses:
YOU ARE FURTHER NOTIFIED that if no written comments or protests are received
within the time limit set, the Commission will consider this matter on its merits and enter its order
without a formal hearing. If written comments are received within the time limit set, the
Commission will consider them and, in its discretion, may set the same for formal hearing.

OCTOBER 5, 2021, AT 7:00 PM (MDT). The purpose of the workshop is to provide customers
with an overview of the Application and Staff’s analysis regarding the proposed acquisition of
Eagle Water by SUEZ and its potential impact on customers. At the workshop, customers may
ask Staff about the Application and how customers may further participate in the proceeding.
Representatives of the Companies may also be available. To participate online, please visit
idahogov.webex.com and enter 2463 517 8624. At the next window, enter your name, e-mail
address and the password OctoberWorkshop. To participate by telephone, please call 1-415-
655-0001 and enter the passcode 2463 517 8624 when prompted.
NOTICE OF CUSTOMER HEARING
YOU ARE FURTHER NOTIFIED that the Commission will conduct a telephonic
customer hearing in this matter on MONDAY, NOVEMBER 1, 2021, AT 7:00 PM (MST). The
purpose of the public hearing is to take testimony from members of the public and customers of
the Companies. To participate by telephone, please call 1-415-655-0001 and enter the passcode
2456 479 3535 when prompted. Those planning on testifying are encouraged to join the hearing at
6:30 PM (MST).
YOU ARE FURTHER NOTIFIED that depending on the attendance and public
interest, the Commission may impose a five (5) minute cap on individual’s testimony to ensure
that all interested persons have an opportunity to present their positions on the record.
Additionally, interested persons who have lengthy testimony are encouraged to file their full
testimony—or the portion exceeding the time limit—in accordance with the public comment
instructions.

IT IS HEREBY ORDERED that the procedural schedule as set forth in the above
Notice of Scheduling is approved.
IT IS FURTHER ORDERED that the Amended Joint Application be processed by
Modified Procedure, Rule 201-204 (IDAPA 31.01.01.201-.204). Staff and Intervenors must file
comments by October 13, 2021. Staff and Intervenors must file any reply comments by October
20, 2021. The Companies must file any reply comments by October 27, 2021. Interested persons
must file any comments by November 8, 2021.

IT IS FURTHER ORDERED that Commission Staff hold a telephonic, public,
informational, customer workshop on Tuesday, October 5, 2021, at 7:00 PM (MDT).
IT IS FURTHER ORDERED that the Commission will hold a telephonic customer
hearing at which customers and interested members of the public may testify on Monday,
November 1, 2021, at 7:00 PM (MST).
IT IS FURTHER ORDERED that parties should continue to comply with Order No.
35058, issued June 3, 2021. All pleadings should be filed with the Commission electronically and
shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service
between parties should also be accomplished electronically. Voluminous discovery-related
documents may be filed and served on CD-ROM or a USB flash drive.
