This matter comes before the Commission on Suez Water Idaho,Inc.'s Unopposed
Motion for Stay (the "Motion").By way of background,Suez and Eagle Water Company have
jointly applied to the Commission for an order approving Suez's proposed acquisition of Eagle
Water.Suez explains that,during the proceeding,Intervenor City of Eagle sued Eagle Water in
District Court and claimed a right of first refusal to buy Eagle Water's system.Because the
Commission's decision on the Suez/Eagle Water Application may be affected by the outcome of
the District Court litigation,Suez has moved to stay the Commission proceeding pending a final
resolution of that litigation.Suez represents that the other parties to the Commission proceeding
do not oppose the Motion.
Having reviewed Suez's Motion,the Commission finds it reasonable to grant Suez's
Motion as follows:
ORDER
IT IS HEREBY ORDERED that Suez's Motion is granted.This case is stayed subject
to these conditions:
1.The Commission retains full jurisdiction over the Joint Application;and
2.The Joint Applicants must provide the Commission and other parties with quarterly
reports on the status of the litigation,Case NO.CV01-19-03534 in the District Court
for the Fourth Judicial District,State of Idaho,Ada County.
