STIPULATION AND MOTION
TO DISMISS WITH PREJUDICE

COME NOW the parties to the above entitled appeal, by and through their respective
counsel of record, pursuant to IAR 33, and stipulate and agree that this appeal may be dismissed
with prejudice, with each party to bear their own costs, and in support thereof, respectfully show
as follows, to wit:
1. On February 10, 2006, after the filing of this appeal, Appellant, United Water Idaho
Inc., (United Water) filed an Application at the Idaho Public Utilities Commission (Commission)
for a general rate increase, Case No. UWI-06-02.
STIPULATION AND MOTIONTO DISMISS WITH PREJUDICE- 1
2. On May 22 2006 , United Water and the Staff of the Commission entered into a
Settlement Stipulation resolving all outstanding issues in Case No. UWI-06-02. A term of the
Settlement Stipulation was United Water s agreement to dismiss this appeal. The Settlement
Stipulation was conditioned upon approval by the Commission.
3. On July 24 2006 the Commission entered Order No. 30104 in Case No.UWI-06-
which approved the Settlement Stipulation in full.
WHEREFORE the parties jointly move the Court for an Order dismissing this appeal
with prejudice, with each party to bear their own costs.
