RATES AN CHARGES FOR WATER
SERVICE IN THE STATE OF IDAHO
COMES NOW Spirit Lake East Water Company ("Spirit Lake" or "Company")
and fies this Status Report in response to the Idaho Public Utilities Commission's
("Commission") requirement that the Company "fie a detailed written plan and schedule
showing start and completion dates. . . . demonstrating a commitment to install a new
generator and address system leaks as directed by the Commission in Order No. 30279."
Order No. 30315 at p. 5.
As was previously submitted in this case, Spirit Lake entered into a consent order
(the "Consent Order")with the Idaho Deparment of Environmental Quality ("DEQ")
that required the Company to develop and submit to DEQ a detailed Public Water System
Corrective Action Plan ("CAP Plan") which includes, but is not limited to:
. The installation of a backup generator capable of rung the submersible well
pump and the three centrfugal water pumps used to pressurize the water
distribution system.

· The development and implementation of a maintenance program to ensure that
the generator and all associated equipment is taken care of appropriately.
. A detailed plan and schedule to evaluate and address any and all deficiencies
associated with the electrical and pumping systems.
. A detailed plan and schedule for conducting a leak detection surey providing
written survey results to the DEQ which, at a minimum, identify the location and
estimated intensity of all leaks detected.
· A plan and schedule to repair the reservoir roof to ensure that the roof is
watertight, that ponding of water is eliminated, and that the roof is sloped so that
water drains off the surface.
The Company has completed each of the above tasks and after a DEQ inspection,
Spirit Lake was informed by the agency through written correspondence on
November 12,2008 that the Consent Order was terminated and that the water system had
been reapproved as a public drnking water system under DEQ's authorities. This
correspondence has been attached for the Commission's review as Exhibit A. The
Company has also attached the results of the most recent leak detection surey. Through
its leak detection efforts, the Company has located and repaired numerous leaks in the
system thereby signficantly reducing system water loss. See Exhibit B. Spirit Lake is
continuing its leak detection efforts as par of its ongoing maintenance to attempt to
locate and repair any additional leakage.

1. Pursuant to Idaho Code § 39-101 through 39-130, the Idaho Environmental
Protection and Health Act (EPHA), the Idaho Departent of Environmental
Quality (Departent) entered into a Consent Order with Spirit Lake East Water
Company, PWS 101280176, which was effctve June 5, 2007.
2. The Department finds that the requirements of the Consent Order have been met
and hereby terminates the Consent Order.
3. Termination of the Consent Order shall not relieve the responsible parties from
any obligation to comply with the provisions of the Idaho Rules for Public
Drinking Water Systems or any other applicable local, state, or federal laws.
4. The effectve date of this Termination of Consent Order shall be the date of
signature by the Director of the Idaho Department of Environmental Quality.
