ROC-W-21-01 ORDER NO. 35590 On May 25, 2022, the Idaho Public Utilities Commission (“Commission”) issued Order No. 35418. The Commission ordered Rocky Mountain Utility Company, Inc. (“Company”) to “take daily water pressure readings from appropriate locations on the Company’s water system for 14 days.” Order No. 35418 at 11. On October 13, 2022, the Company submitted a spreadsheet containing water pressure readings and a map showing the location of each reading. Commission Staff (“Staff”) reviewed the Company’s submission and, based upon its review, believed that the Company substantively complied with the Commission’s order. However, Staff noted that the Company was out of compliance with the time frame set by the Commission to report the data. COMMISSION DECISION AND FINDINGS The Commission has jurisdiction over this matter and the issues in this case under Title 61 of the Idaho Code. Specifically, the Commission regulates “public utilities,” including “water corporations” that serve the public or some portion thereof for compensation. See Idaho Code §§ 61-125, -129, and -501. According to the data provided by the Company from its daily pressure readings between September 21, 2022 and October 4, 2022, the range of system pressure was maintained between 68 and 70 pounds per square inch (“PSI”). As Staff noted this is above the 20 PSI minimum that the Department of Environmental Quality requires. See IDAPA 58.01.08.552.01.b.i. Having reviewed the record, the Commission finds that, while procedurally untimely, the Company has substantively complied with the directives set forth in Order No. 35418. ORDER IT IS HEREBY ORDERED that the Company has complied with Order No. 35418. THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date upon this Order regarding any matter decided in this Order. Within seven (7) days after any person has petitioned for ORDER NO. 35590 2 reconsideration, any other person may cross-petition for reconsideration. See Idaho Code §§ 61- 626 and 62-619.
