HomeMy WebLinkAbout20231212Decision Memo.pdfDECISION MEMORANDUM 1 DECISION MEMORANDUM TO: COMMISSIONER ANDERSON COMMISSIONER HAMMOND COMMISSIONER LODGE COMMISSION SECRETARY COMMISSION STAFF LEGAL FROM: CHRIS BURDIN DEPUTY ATTORNEY GENERAL DATE: DECEMBER 12, 2023 SUBJECT: IN THE MATTER OF THE FORMAL COMPLAINT OF ARROWROCK RANCH ASSOCIATION, INC.; CASE NO. MSW-W-23-01. On December 1, 2023, Arrowrock Ranch Association, Inc. (“Arrowrock”) filed a formal complaint (“Complaint”) against Mayfield Springs Water Company, Inc. (“Mayfield”) with the Idaho Public Utilities Commission (“Commission”). Arrowrock alleges that Mayfield violated an agreement to provide public drinking water through a water system that serves the Arrowrock community and its members/homeowners. Arrowrock requests that the Commission issue an order: (1) finding that Mayfield failed to provide safe and reliable service; (2) forbidding Mayfield from failing to provide safe and reliable service; (3) finding that Mayfield has failed to provide sufficient and/or otherwise adequate water supply and volume to the subject water system; (4) finding that Mayfield has made unjust and unreasonable charges for water and/or water service and its conduct has been, and is, prohibited and unlawful; (5) prohibiting Mayfield from failing to provide a sufficient and/or otherwise adequate amount of water supply and volume of water to the subject water system; and (6) requiring Mayfield to upgrade or otherwise sufficiently improve its provision of water supply and volume in order to provide safe and reliable service to the water system users. RECOMMENDATION Commission Staff (“Staff”) recommends the Commission issue a Summons to Mayfield directing it to answer or otherwise respond to the Complaint within twenty-one (21) days and allow fourteen (14) days for Arrowrock to reply.
