FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY NOTICE OF APPLICATION CASE NO. ISW-08- NOTICE OF INTERVENTION DEADLINE ORDER NO. 30512 On February 5, 2008 , Idaho Springs Water Company, Inc., an Idaho corporation filed an Application requesting a Certificate of Public Convenience and Necessity to provide water service as a public utility. Idaho Code ~ 61-526; IDAPA 31.01.01.111. The Company currently provides water service within the Arrowrock Subdivision in Kuna to 38 residential customers, 17 connections taking service during the construction of residential dwellings, and 1 customer taking service to water common areas. The Company maintains that additional development of the Arrowrock Subdivision and surrounding territory could increase the number of customers to more than 200. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that the Company asserts that the proposed service area is not within, and therefore will not interfere with, the authorized territory of any other public utility water corporation. The Application contains exhibits regarding the proposed service area, technical drawings and maps submitted to the Idaho Department of Environmental Quality, consumptive use figures, and other financial data. YOU ARE FURTHER NOTIFIED that the Company s present water rates include the following: $25 flat fee per month for connections to lots upon which construction of a residential dwelling is occurring, $50 flat fee per month for residential customers, and $800 flat fee per month for water service to common areas. The Company requests authorization to continue charging its current rates and charges until such time as they are set by final Order the Commission. NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 30512 YOU ARE FURTHER NOTIFIED that the Company proposes a rate for residential customers that would include a set monthly charge and an additional, variable, amount determined by monthly consumption. It anticipates a residential monthly charge between $50- $100 per customer. YOU ARE FURTHER NOTIFIED that several informal consumer complaints and one formal consumer complaint have been filed with the Commission against the Company (and its predecessor) alleging that it has been operating without the proper authorization of the Commission. YOU ARE FURTHER NOTIFIED that the Company has asked that its Application be processed under Modified Procedure, IDAP A 31.01.01.201-204. The Commission anticipates that the parties will discuss how to process this case after the Notice of Parties has been issued. YOU ARE FURTHER NOTIFIED that the Application, supporting workpapers and exhibits have been filed with the Commission and are available for public inspection during regular business hours at the Commission offices. The Application and other workpapers are also available on the Commission s Website at www.puc.idaho.gov under the "File Room" and then "Water Cases. YOU ARE FURTHER NOTIFIED that the Commission finds that the Company existing rates shall serve as interim rates, until the Commission approves final rates. The interim rates shall be subject to refund. DEADLINE FOR INTERVENTION YOU ARE FURTHER NOTIFIED that persons desiring to intervene in this matter for the purpose of presenting evidence or cross-examining witnesses at hearing must file a Petition to Intervene with the Commission pursuant to the Commission s Rules of Procedure 72 and 73 , IDAPA 31.01.01.072 and .073. Persons intending to participate at hearing must file a Petition to Intervene no later than 14 days from the service date of this Order. Persons seeking intervenor status shall also provide the Commission Secretary with an electronic mail address to facilitate further communications in this matter. YOU ARE FURTHER NOTIFIED that persons desiring to present their views without parties' rights of participation and cross-examination are not required to intervene and may present their comments without prior notification to the Commission or to other parties. NOTICE OF APPLICATION NOTICE OF INTERVENTION DEADLINE ORDER NO. 30512 YOU ARE FURTHER NOTIFIED that once the deadline for intervention has passed, the Commission Secretary shall issue a Notice of Parties. The Notice of Parties shall assign exhibit numbers to each party in this proceeding. YOU ARE FURTHER NOTIFIED that after the Notice of Parties is issued, the Commission anticipates that the parties will informally convene to devise a recommended schedule to process this case. In addition to the schedule, the parties may discuss discovery logistics, electronic service, and other scheduling matters. YOU ARE FURTHER NOTIFIED that the Commission has jurisdiction over this matter pursuant to Title 61 of the Idaho Code and specifically Idaho Code ~~ 61-124, 61-125 61-129, and 61-526. The Commission may enter any final Order consistent with its authority under Title 61. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission s Rules of Procedure, IDAP A 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that persons desiring to intervene in this case for the purpose of presenting evidence or cross-examination at hearing shall file a Petition to Intervene with the Commission no later than 14 days from the service date ofthis Order. IT IS FURTHER ORDERED that the Company continue to charge its current/interim rates and charges, subject to refund, until such time as final rates and charges are approved by Order of the Commission. IT IS FURTHER ORDERED that the Commission Secretary serve this Order upon those customers who have filed informal complaints against the water company. IT IS FURTHER ORDERED that after the Notice of Parties is issued, the Staff shall informally convene with the parties to discuss the processing of this case.
